A reading of the 1997 court decision Brigham v. State

December 31, 2021: In 1997, the Vermont Supreme Court ruled in favor of plaintiffs in the Brigham v. State court case.

This landmark case stated that funding public schools through town-by-town property taxes created inequalities for students. This, said the court, was unconstitutional. The Brigham decision sparked the passage of Act 60 and an overhaul of how the state funded public schools.

As we end 2021 and prepare for the new Legislative Session, Olga and Emilie read the Brigham decision and reflect on how it has shaped Vermont.
